JUSTICE KHATIM REZA ORAL ORDER 3 07-02-2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner seeks bail in connection with Harsidhi P.S. Case No. 446 of 2024 dated 18.08.2024 registered for the offence punishable under Sections 316(2), 318(4), 126, 115(2), 111, 303(2), 61(2), 127(1) of Bhartiya Nyay Sanhita. 3. The prosecution case, in short, is that on 15.08.2024 the informant alongwith his brothers, namely, Devendra Prakash Ojha and Virendra Arora, on the instigation of one Sahbaj Khan, reached at the house of co- accused Amrendra Singh to meet with one Thakur of Gopalganj District in connection with exchanging mutilated
Patna High Court CR. MISC. No.1297 of 2025(3) dt.07-02-2025 2/3 notes of Rs. 24 Lakhs and in lieu of that mutilated notes informant had to pay Rs. 12 Lakhs Indian currency notes. After some time, in greed of money, all the accused persons named in the F.I.R. including this petitioner and 7-8 unknown persons assaulted the informant and his brothers and looted a bag, containing Rs. 12 Lakhs of the informant and also snatched gold chain, purse and watch from the brothers of the informant and fled away. 4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that during investigation Rs. 50,000/- has been recovered from the house of Satyam Kumar and 10,000/- has been recovered from the pocket of the petitioner. It is submitted that F.I.R. has been lodged after three days of the occurrence. It is also submitted that for the alleged recovery of Rs. 10,000/-, the petitioner has not been put on T.I.P. till date. It is further submitted that Satyam Kumar has been granted bail vide order dated 22.01.2025 passed in Criminal Miscellaneous No. 83945 of 2024 by this Court.
Lastly, it has been submitted that the petitioner is in custody since 19.08.2024, having no

Learned A.P.P for the State opposes the prayer for bail of the petitioner. 6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-Ist Class, East Champaran at Motihari in connection with Harsidhi P.S.
