By way of instant Execution Petition, prayer has been made on behalf of the petitioner for implementation/ execution of
judgment dated 31.10.2023 passed by this Court in CWP No. 8230 of 2023, titled Krishan Chand vs. Himachal Road Transport Corporation & another, whereby direction came to be issued to the respondents to consider and decide the case of the petitioner in light of judgment dated 17.7.2014 passed by Division Bench of this Court in CWP No. 3050 of 2014, titled Nek Ram versus State of Himachal Pradesh and others, in a time bound manner. came to be done on behalf of the respondents, he approached this Court in the instant proceedings.

Before notices could be issued in the instant proceedings, Mr. Dheeraj K. Vashishat, Advocate has put in appearance on behalf of the respondents. He states that mandate contained in the judgment, sought to be executed, stands duly complied with. To substantiate his aforesaid plea, he placed on record communication dated 23rd May 2025, issued under the signatures of Divisional Manager (R/O) HRTC Hamirpur, Himachal Pradesh, perusal whereof reveals that afore authority has already
directed the Financial Advisor & Chief Accountant Officer, Himachal Road Transport Corporation Shimla with regard to payment of DCRG and Leave Encashment. As per aforesaid communication, sum of Rs. 10,46,875/- and Rs. 8,37,500/- with regard to DCRG and leave encashment stands paid to the petitioner by way of cheques No.40032 &, 40033, dated 22.02.2024. Besides above, interest amounting Rs. 39,494/- and Rs. 31,596, on account of delayed payment has been also paid to the petitioner vide cheques No.40027 & 40028 dated 22.02.2024.

Having perused aforesaid communication,
learned counsel representing the petitioner fairly acknowledging factum with regard to compliance. In view of the above, nothing remains to be

adjudicated in the present petition and accordingly same is disposed of. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate Court of law qua the surviving grievance, if any.
