Heard learned counsel Mr.B.Chowdhurry for the petitioner, Jallal Ali @ Jalal Ali who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 13.12.2024 in connection with Bijni P.S.Case No. 01/2025 under Sections 305/ 331(4)/111(2)/(4) of the BNS. Page No.# 2/3 2. Heard learned Addl.Public Prosecutor Mr. D.P.Goswami for the respondent State, who has submitted that this bail petition cannot be considered without perusal of the case diary. 3. Case diary is not received. 4. The allegation against the petitioner is that he is involved in committing theft of 80 kgs of supari from the warehouse of the informant. 5. I have considered the submission that the petitioner has been behind bars for 75 days. Investigation may have presumably progressed substantially. It appears that further custodial detention of the petitioner may not be required for progress of investigation. The petitioner is a local resident and he is not at a flight risks. 6. The petitioner has pledged to abide by any stringent bail conditions if imposed upon him. 7. Considering all the aspects, the bail prayer of the petitioner is hereby allowed. 8. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs.30,000/- with a suitable surety of like amount to the satisfaction of the learned SDJM, Bijni, Chirang (BTAD), Assam under the conditions that:- (i)That the petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation, (ii) That the petitioner shall refrain from such activities with which he is alleged, Page No.# 3/3 (iii) That the petitioner shall not leave the jurisdiction of the Court without prior permission. 9. On breach of any of the bail conditions, jurisdictional Court is at liberty to immediately cancel the bail granted to the petitioner. 10.
