THIS COMMERCIAL APPEAL UNDER SECTION 13(1A) OF THE COMMERCIAL COURTS ACT, 2015 PRAYING TO SET ASIDE THE JUDGMENT AND DECREE DATED 08.01.2025 PASSED BY THE LXXXV ADDITIONAL CITY CIVIL AND SESSIONS JUDGE, AT BENGALURU (CCH 86) (COMMERCIAL COURT) PASSED IN COM.OS NO. 386/2023, IN THE INTEREST OF JUSTICE AND EQUITY. 2 THIS APPEAL COMING ON FOR CONCILIATION BEFORE HIGH COURT LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. Heard Sri V.B.Siddaramaiah, learned advocate for the appellant, Sri Hemanth Kumar, G.M., learned advocate for respondent. 2. Both learned advocates submit that the parties have settled the dispute amicably and filed a Joint Memo of even date. They pray that this appeal be disposed of in terms of settlement recorded in the Joint Memo. 3. Appellant and respondent are present and identified by their respective advocates. The Joint Memo is duly signed by the appellant, respondent and their respective advocates. 4. Both appellant and respondent admit the terms of settlement stated in the Joint Memo. The same is lawful and hence accepted. The Joint Memo reads as follows:
”JOINT MEMO
(To refer the matter to Lok-Adalath)
1. The Appellant and Respondent have agreed to settle their dispute. The Appellant/Defendant has agreed to pay Rs.11,50,000/-(Eleven Lakh Fifty Thousand Rupees only) to the Respondent/Plaintiff, towards full and final settlement of the dispute amount including interest. The Respondent/Plaintiff has agreed to receive amount of Rs.11,50,000/- (Eleven Lakh Fifty Thousand Rupees only) towards full & final settlement of the dispute amount including interest. 3

At the time of filing this Joint Memo, the Appellant has paid Rs.5,00,000/-(Five Lakhs only) towards part payment to the Respondent, by way of Electronic transfer to Respondent's Bank Account No.: 035905005709, (ICICI Bank, K.G. Road Branch, Bengaluru, IFSC:ICIC0000359], from Appellant's Bank Account No.74710100002105, [Bank of Baroda, Gandhinagar Branch, Bengaluru and the Respondent/Plaintiff has accepted, the receipt of aforesaid amount of Rs.5,00,000/-, towards part payment of settled amount of Rs. 11,50,000/-. Wherefore, the parties pray to refer the matter to the Lok- Adalath, to further payment of amount, in the interest of justice & equity."
