JUSTICE M.I.ARUN ORAL ORDER On the ground that the brother of the complainant (accused no.1) had executed a General Power of Attorney in favour of the petitioners herein (accused nos.2 and 3) in respect of a property belonging to the complainant and that the petitioners had thereafter sold the same in favour of third parties (accused nos.4 and 5), the complainant lodged a complaint with respondent no.1-Police which resulted in C.C.No.19927/2017 being registered on the file of I Additional Chief Metropolitan Magistrate, Bengaluru. 2. The present petition is filed challenging the proceedings against the petitioners in C.C.No.19927/2017. The contention of the petitioners is that, they were not aware as to who was the owner of the property. Accused no.1 represented to them that he is the actual owner of the property and produced certain documents and believing the same to be true the petitioners accepted the GPA executed by - 4 - HC-KAR NC: 2025:KHC:45727 CRL.P No. 1487 of 2019 accused no.1 in their favour and thereafter have sold the property to third parties. It is further submitted the said transaction also gave rise to a civil dispute between the complainant and accused no.1 who is none other than her brother and that the said civil dispute has ended in a compromise and the complainant herself has given a statement before respondent no.1-Police stating that there is no fault on part of the petitioners herein. 2. Respondent no.2/complainant is served and unrepresented. 3. Learned High Court Government Pleader upon instruction submits that the case is essentially civil in nature and the same has ended in a compromise and he also submits that respondent no.2 has subsequently given a statement before the Police stating that there is no fault on the part of the petitioners herein and that she is satisfied by the compromise. His submission is placed on record. 4. Hence the following: - 5 - HC-KAR NC: 2025:KHC:45727 CRL.P No. 1487 of 2019 ORDER 1. The proceedings in C.C.No.19927/2017 pending on the file of I Additional Chief Metropolitan Magistrate, Bengaluru insofar as it relates to the petitioners herein are concerned stand quashed; 2.
