Reply by way of an affidavit of Mahabir Singh, HPS, Deputy Superintendent of Police, Nilokheri, Karnal has been filed on behalf of respondents-State in the Registry, which is taken on record. It has been alleged in the status report that the complaint of petitioner Raj Rani dated 02.06.2025 was marked to HC Sanjeev Kumar for inquiry. Both the complainant and the accused were associated in the inquiry proceedings. During the inquiry, no evidence was found to substantiate the allegation that the money had been taken for arranging a job or criminal breach of trust was committed. It was revealed that the matter was purely a case of personal monetary transaction between the parties. The accused produced screenshot showing that Rs.42,000/- had already been deposited into the complainant's bank account, which was confirmed during KOMAL 2025.09.17 10:13 I attest to the accuracy of this document CRM-M-41614-2025 (O&M) -2- the inquiry. Both the parties orally stated that they were engaged in a panchayat level settlement and the accused would pay the remaining amount shortly. In view of the same the said complaint was filed. Subsequently, the petitioner submitted another complaint dated 02.07.2025, registered vide Diary No.4356-CMISC, which was marked to SI Gurbachan Singh. During inquiry, notice was issued to both the parties for appearance and for recording of statements, but none of the parties appeared before the inquiry officer. Due to transfer of SI Gurbachan, the matter was marked to SI Anil Kumar. Upon fresh scrutiny, SI Anil Kumar concluded that the matter was again found to be a dispute of financial dealings between private individuals. No criminal intent could be established. The said complaint was also filed. It has been submitted that the local police conducted a fair and unbiased inquiry both the times as per law. The matter might be re-examined, if any, fresh concrete evidence indicating criminal intent or fraud would be brought on record. Regarding the petitioner's request for protection, it has been alleged that no direct threat to life or property has been reported to the police, if any, such situation would arise then appropriate legal protection shall be extended immediately.
