ORAL ORDER
Heard and perused the material on record.
2. On the basis of a complaint lodged by one Mohammed Ameen son of Mahammed Ashraff, Ashoknagar Police, Bengaluru City have registered a case in their station Crime No.373/2024, against accused Nos.1 to 7 and one World White Resort Company, arraigned as accused No.8, for the offence punishable under Section 420 of IPC. Petitioner is arraigned as accused No.3 in the FIR.

It is alleged that one Naveen Althaff introduced Shivamurthy (accused No.2) to the complainant, who induced the complainant to purchase a land originally belonging to one Dallappa, stating that one Kamalesh Jain (accused No.1) has entered into a sale agreement to purchase the said land for a sum of Rupees 13.00 crores

and if he purchase the said land and sell it to World White Resort Company, then he would get double the profit. He has stated that a sum of Rs.1,46,16,500/- was given to Shivamurhty in instalments, inturn the said amount was given to Kamalesh Jain. Thereafter, complainant transferred a sum of Rs.3.50 Crores to the said kamalesh Jain. It is alleged, all the accused have cheated the complainant without registering the land and also not returning the amount.
4. There are no specific allegations in the complaint that this petitioner, arraigned as accused No.3, has received any money from the complainant. It is alleged that the amount given to Shivamurthy i.e., accused No.2 was later given to accused No.1 and thereafter, the complainant got acquainted with the said accused and transferred about Rs.3.50 Crores to him, in instalments.

Learned counsel for petitioner submits that accused No.1 was arrested and he has been enlarged on

bail. Accused Nos.2 and 7 are granted bail by this Court in Crl.P.No.10515/2025 and Crl.P.No.11614/2025.
6. Petitioner has undertaken to cooperate with the investigation of the case. He has no criminal antecedents. He is said to be a permanent resident of the address given in the cause title. The relief sought in the petition can be granted by imposing conditions. Accordingly the following:-
ORDER
i) Petition is allowed. ii) Petitioner/accused Nos.3 in Crime No.373/2024 registered by Ashoknagar Police Station, shall be released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum.

b) He shall furnish proof of his residential address/contact number and shall inform the I.O. in case of change in the address/contact number. c) He shall co-operate with the investigation of the case. d) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) He shall be regular in attending the Court proceedings.
