HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 2070 OF 2025
ORDER:
As per the directions of My Lord the Hon'ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025.

This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioners-accused Nos. 1 to 5 seeking to release them on bail in the event of arrest in crime No. 83 of 2023 of Tadimarri Police Station, Sri Sathya Sai District. The said crime was registered initially for the offences punishable under Sections 447 and 324 read with Section 34 IPC and subsequently, Section 326 IPC is added.
3. Heard Sri K.Narsi Reddy, learned counsel appearing for the petitioners-accused Nos. 1 to 5, and learned Additional Public Prosecutor appearing for the respondent-State.
4. Case of the prosecution is that de facto complainant is resident of Kunukuntla Village of Tadimarri Mandal and eking out his livelihood by doing agriculture. He is having Ac. 5.00 cents of
2 agricultural land in survey No. 420 of Kunukuntla Village. Originally, the said land belongs to his paternal uncle by name Kollayappa. The said Kollayappa is having one daughter and one son who is shown as accused No. 6 in the present crime. It is further alleged that the said Kollayappa adopted de facto complainant and as such, there are civil disputes pending between the issues of Kollayappa and de facto complainant. During pendency of the civil proceedings, accused No. 1 purchased the subject property from accused No. 6 i.e. son of Kollayappa, for which de facto complainant objected. While so, on 14-07-2023 at about 8 a.m. when de facto complainant and his younger brother were at the fields, all the petitioners along with accused No. 6 came with a JCB and tried to level the land. When de facto complainant and his younger brother objected for the same, the accused are said to have beaten de facto complainant and his younger brother and inflicted injuries. On the basis of the said allegations, the present crime has been registered against the petitioners and another.

Learned counsel appearing for the petitioners-accused Nos. 1 to 5 contends that it is only to pressurize the petitioners in the civil proceedings, de facto complainant resorted to the present criminal prosecution and that the alleged incident said to have taken place on 14-07-2023.
6. This Court has perused the entire material available on record. Though the crime has been registered as early as on 14-07-2023, the police could not apprehend the petitioners till date. As such, the investigation could not be proceeded with. In view of the above facts and circumstances, as the incident is an outcome of civil disputes between de facto complainant and the petitioners and as the incident took place on 14-07-2023, this Court is inclined to grant anticipatory bail to the petitioners- accused Nos. 1 to 5 with certain conditions.
7. The petitioners-accused Nos. 1 to 5 are, therefore, directed to surrender before the Station House Officer, Tadimarri Police Station, Sri Sathya Sai District, on or before 17-04-2025. On such surrender, the petitioners-accused Nos. 1 to 5 are ordered to be enlarged on bail on their executing each a personal bond for
4 Rs.10,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, Tadimarri Police Station. After release, the petitioners-accused Nos. 1 to 5 are directed to report before the Station House Officer, Tadimarri Police Station, once in a week i.e. on every Monday between 10 a.m. and 1 p.m. until further orders.
8. Accordingly, the criminal petition is allowed.
