In the said suit, I.A.No.3 was filed by the petitioner under Order I Rule 10(2) read with Section 151 of CPC with a prayer to implead her as party defendant No.3 to the suit. Considering the set aspect of the matter, I am of the opinion that the petitioner is a proper and necessary party for the purpose of effectively adjudicating the dispute involved in the suit and the Trial Court has failed to appreciate this aspect of the matter and has erred in rejecting I.A.No.3 filed on behalf of the plaintiff.
