Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Chhattarpur P.S. Case No.204 of 2024 registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2), 117(2), 118(1), 109, 74, 303(2), 352 and 351(2) of the B.N.S., 2023.
Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner, being a member of an unlawful assembly, in prosecution of common object of the assembly attempted to murder the informant and her brother-in-law and outraged the modesty of the informant. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-11 of this bail application. It is then submitted that the petitioner has been in custody since 21.11.2024 as has been mentioned in paragraph no. 11 of the bail application. It is further submitted that the petitioner undertakes that he will not go over the place of occurrence land; as the petitioner has no concern with the said land and he will not annoy or disturb the informant, victim or their family members in any manner during the trial of the case. It is lastly submitted that the co-accused person has already been given the privilege of anticipatory bail by
this Court vide order dated 28.03.2025 in A.B.A. No.2081 of 2025 and the co-accused person has also been admitted to bail by a coordinate Bench of this Court vide order dated 21.03.2025 in B.A. No. 2255 of 2025. Hence, it is submitted that the petitioner be also admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Palamau at Daltonganj, in connection with Chhattarpur P.S. Case No.204 of 2024 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant, victim or any of their family members in any manner during the trial of the case nor will he go over the place of occurrence land during the trial of the case.
