V.Sireesha Rani Standing Counsel for R2 and R3 The Court made the following Order: The learned counsel for the petitioner submits that the respondents are intending to demolish the shops belonging to the petitioner which are abetting the road. It is submitted that the said shops have been existing since last two decades and that the petitioner has obtained valid permission and also paying the relevant municipal taxes. 2. It is submitted by the learned counsel for the petitioner that the respondents intend to widen the road which would require the acquisition of the shops belonging to the petitioner. 2 3. It is submitted by the learned counsel appearing for the petitioner that the respondents without issuing any notice and are trying to demolish the shops without following any procedure as established by law. 4. The learned standing counsel for the respondents 2 and 3 submits that as of now no notice is issued to the petitioner. Considering the same, the writ petition is disposed off with a direction to the respondents not to dispossess the petitioner from the shops situated in Sy.No.15/1 with Assessment Nos.1133011880 & 1133000960 an extent of 152.84 Sq.yards at Palakonda Road, Rajam Town and Municipality, Vizianagaram District without following the due process of law. There shall be no order as to costs.
