JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of BNSS praying to grant bail in Crime No.221/2025 of Kodigehalli Police Station registered for offences punishable under Sections 420, 504, 506, 34 of IPC. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Learned counsel for petitioner would contend that the accusation against the petitioner is that she collected money from different persons and also from first informant promising to get them a government job. The said allegation of collecting money is of the year 2002 and FIR - 3 - HC-KAR NC: 2025:KHC:45492 CRL.P No. 15271 of 2025 is filed in the year 2025 and there is a delay in filing the complaint. The accusations against the petitioner are all false allegations. The account to which the amount has been transferred is not standing in the name of the petitioner. The petitioner has been taken to police custody between 16.10.2025 to 23.10.2025 and she has been interrogated. Therefore, the petitioner is not required for further custodial interrogation. The petitioner is ready to co-operate with the police in further investigation. The petitioner is a woman. She is running five educational institutions. She is M.Phil, Phd and to tarnish her image, a false case has been foisted against her. Accused No.1 who is also having similar allegations has been granted anticipatory bail by this Court in Crl.P.No.13994/2025 by order dated 16.10.2025. The petitioner is suffering from cervical spondylosis and she requires treatment. With these he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that not only complainant, other 70 victims have given - 4 - HC-KAR NC: 2025:KHC:45492 CRL.P No. 15271 of 2025 money to the petitioner and other accused to get a Government job. The petitioner and other accused have collected Rs.91,00,000/-. There is a transfer of Rs.20,00,000/- to the account of this petitioner and Rs.1,00,000/- to the account of accused No.1. From accused No.1, Rs.20,00,000/- cash has been recovered. Accused Nos.3 to 6 are absconding. If the petitioner is granted bail, she will hamper the investigation and tamper the prosecution witnesses. With these she prayed for dismissal of the petition. 5. Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record. 6. On the first information filed by one Hanamanth, case came to be registered against the petitioner and others in Crime No.221/2025 of Kodigehalli Police Station for offence punishable under Sections 420, 504, 506, 34 IPC. The accusation against petitioner/accused No.2 and others in the said first information filed by one Hanamanth - 5 - HC-KAR NC: 2025:KHC:45492 CRL.P No. 15271 of 2025 is that the petitioner and other accused promised 70 persons to get them government jobs and cheated them by not providing government jobs. The alleged offence is not punishable either with death or imprisonment for life. The petitioner has been interrogated in police custody from 16.10.2025 to 23.10.2025. Therefore, she is not required for further custodial interrogation. Petitioner has undertaken to co-operate with the police in the investigation and abide by conditions to be imposed by this Court. As per certificate produced, the petitioner is a woman and she is suffering from cervical spondylosis. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed. The petitioner is granted bail in Crime No.221/2025 of Kodigehalli Police Station subject to following conditions: - 6 - HC-KAR NC: 2025:KHC:45492 CRL.P No. 15271 of 2025 (i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like sum to the satisfaction of the jurisdictional Court. (ii) Petitioner shall co-operate with the IO in the investigation. (iii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly.
