This is a Civil Revision Petition filed under Article 227 of the Constitution of India for setting aside the impugned order dated 28.05.2025 vide which the application under Order 7 Rule 11 CPC preferred by the petitioner has been dismissed. 2. Learned counsel for the petitioner has submitted that earlier the impugned order was challenged by filing CR-4734-2025 which was disposed of vide order dated 25.07.2025 with the following order:- “1. A perusal of the paper-book would show that neither the plaint nor the last five zimni orders have been annexed so as to see as to whether the suit discloses any cause of action or not and also the stage of the case as the suit was filed in the year 2019. In view of the above, the present revision petition is disposed of with liberty to the petitioner to revive the same after annexing the plaint and also after annexing last five zimni orders.” 3. Learned counsel for the petitioner has submitted that he be permitted to withdraw the present petition with liberty to revive CR-4734- 2025 after complying with the order dated 25.07.2025. 4.
