JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 2 15-02-2025 Heard learned Counsel for the petitioners as well as learned APP for the State. 2. In this case, the petitioners are seeking regular bail in connection with Falka P.S. Case No. 171 of 2024, registered for the offences punishable under Sections 310(4), 310(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(i-b)a, 26 and 35 of the Arms Act. 3. As per allegation, the informant, on the basis of secret information reached at C.S.P. Centre, SBI, Amol and apprehended seven persons including the petitioners herein. 4. Learned counsel for the petitioners submitted that they are innocent and have falsely been implicated. The petitioner, Mukesh Kumar Yadav is the proprieter of C.S.P. and there is no occasion for him to plan for some criminal offence in his C.S.P. Centre. The petitioners except, Bambam Yadav are the person of clean antecedent and so far as Bambam Yadav is concerned, he is involved in one case but it is not of the similar nature. 5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioners. 6. Considering the above-mentioned facts and Patna High Court CR. MISC. No.1612 of 2025(2) dt.15-02-2025 3/3 circumstances, the petitioners, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Katihar in connection with Falka P.S. Case No. 171 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court.
