The court of Principal District Judge, Kupwara, by virtue of a judgment dated 7th September, 2021on File No. 161/2020 came to be hold the guardianship petition filed by the appellant herein-Iffat Anwar wife of Arshid Aziz Malik as not maintainable wherein the appellant had sought guardianship of her two minor children (son), namely, Mohd Nabeel and Mohd Sabeel. 02. The appellant came forward with present statutory appeal instituted on 25th October, 2025. The date of birth of two children is 2017 and 2018 respectively. 03. This Court is being apprised by Mr. Sheikh Manzoor, learned counsel for the respondent that to the best of his information, the parties seem to have reconciled latter on in the manner that there is a divorce which has intervened between two in terms whereof the custody of the two children is now a shared one between the appellant and respondent and this is the reason that his client is not interested, whereas the appellant is also not presenting herself to apprise this Court about the state of affairs, as such, this appeal is dismissed for non-prosecution with liberty reserving in favour of the appellant that in case if she would reckon that appeal was still surviving with her claim to guardianship for her minor children, who, as on date, are 7 and 8 years respectively, then revival of this appeal can be solicited. 04.
