Ajay Basfor and 2. Sulindar Basfor @ Sulindra Basfor, who have filed this application under Section 483 of Page No.# 2/3 Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer bail as they are behind bars since 04.02.2025 in connection with Bhangagarh Police Station Case No. 27/2025 under Sections 329(4)/324(4)/118/3(5) of Bharatiya Nyaya Sanhita, 2023. 2. Heard Mr. D.P. Goswami, learned Additional Public Prosecutor, Assam. 3. The allegation against the petitioners is that they attacked the informant and his family members causing grievous injuries on Sikandar Basfor and Jiten Basfor. 4. Learned Additional Public Prosecutor has submitted that the medico-legal report reveals that both the victim Sikandar Basfor and Jiten Basfor have sustained serious injuries on their heads. 5. I have considered the submissions at the bar with circumspection. I have also scrutinized the Case Diary. There are incriminating materials in the Case Diary against the petitioners. However, investigation has progressed substantially. It appears that custodial detention may not be required for the progress of investigation. 6. Considering all aspects, petition is allowed. 7. The petitioners are enlarged on bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) each with a suitable surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati under the conditions that :- Page No.# 3/3 (i) the petitioners shall refrain from such activities with which they are alleged, (ii) the petitioners shall appear before the Investigating Officer on every fortnight till completion of investigation and, (iii) the petitioners shall not exercise threats to the witnesses and try to influence the witnesses and maintain the peace. 8. On breach of any of the bail conditions, the learned jurisdictional Court/Eleka Magistrate is at liberty to cancel the bail granted to the petitioners. 9.
