3 HBKM.J C.R.P.No.527 of 2025 The Court made the following ORDER: Heard the learned counsel for the petitioners and the learned counsel for the respondents. This revision is filed against the order in I.A.No.355 of 2024 in O.S.No.205 of 2015 on the file of Additional Junior Civil Judge, Pithapuram, dated 22.11.2024, in dismissing the said application to permit the petitioners/plaintiffs to make consequential amendments in the plaint. 2. As per the submissions of both the learned counsels, it appears that initially the suit was filed seeking grant of permanent injunction against the defendants with respect to the plaint schedule property. Subsequently, it appears that the plaintiffs filed l.A. seeking amendment of the prayer in l.A.No.95 of 2020 in the above said suit, which was allowed by the trial Court on 14.02.2020. Accordingly, the amendments were made. However, with the advice of the new counsel as contended by the learned counsel for the petitioner herein, the plaintiffs wanted to re-modify the prayer in the plaint, restricting their relief only for grant of permanent injunction with respect to the suit schedule property. For which, they sought for the consequential amendments as under:
3. “(i) Delete the Para 7A which was added as per the orders dated 14.02.2020 in I.A.No.95 of 2020.
4 HBKM.J * C.R.P.No.527 of 2025 (ii) Delete the Para 10(ii) in valuation para of the plaint which was added as per the orders dated 14.02.2020 in I.A.No;95 of
2020. (Ill) Amend the Para 11 by delete Para 11(e) of plaint (prayer portion of the plaint) which was added as per orders dated 14.02.2020 in I.A.No.95 of 2020.”
4. Accordingly, both the learned counsels suit is at the stage of completion of seeking re-opening of the suit at this now submit that the
arguments. But. they are not stage, the petitioners only sought for the above said amendments in the plaint. But, as the petitioners/plaintiffs are not diligent while finalizing the pleadings at appropriate stage and as there is a delay in filing this application other side shall be suitably compensated with the , the payment of costs respondents/defendants before the one (1) week from today. Subject to necessary amendments of Rs.5,000/-, payable to the Court below within a period of payment of the said costs, the as mentioned above shall be affected in the plaint finally and it clear that the suit need not be is made re-opened, as both the learned counsels submit that it is at the stage of finality on completion of the
arguments. Bearing it in mind, the above said situation. the trial Court shall dispose of the suit strictly in accordance with law. The
order shall be communicated immediately, i involved in the suit. view of the urgency in 9

5. Accordingly, the Civil Revision Petition is disposed of, with costs. As a sequel. Interlocutory Applications pending, if any, shall stand closed.
