SONI SHRIVASTAVA ORAL ORDER 4 04-04-2025 1. Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners have preferred this application for grant of regular bail in connection with Kutumba P.S. Case no.120 of 2024 registered under Section 80 of the B.N.S Act, 2023. 3. As per the prosecution case, the informant states that she married her daughter with one Amresh Paswan in the year 2018. After some days of marriage, all accused persons including the petitioners herein started to assault the informant’s daughter mentally and physically on account of non-fulfillment of demand of dowry. He further states that on 14.07.2024 he received an information from one of the villagers of his Patna High Court CR. MISC. No.86231 of 2024(4) dt.04-04-2025 2/3 daughter that his daughter had been killed by the accused persons. 4. It is submitted by learned counsel for the petitioners that the petitioners are the father-in-law and mother-in-law of the deceased. There is general and omnibus allegation leveled against them in the F.I.R with regard to demand of dowry. The petitioners are also staying separate in mess from their son and the deceased. He further submits that the deceased had committed suicide due to the fact that there was no child out of their wedlock and upon information given by the petitioners, the informant and others had also attended the cremation. Learned counsel further submits that husband of the deceased Amresh Paswan is in custody since 23.09.2024. The petitioners are languishing in custody since 29.09.2024 and undertake to co- operate in investigation/trial. 5. The application for bail is opposed by learned APP for the State. 6. Considering the fact that the petitioners are the father-in-law and mother-in-law of the deceased, they are in custody since 29.09.2024 and also considering the fact that the husband of the deceased is also in custody since 23.09.2024, both the petitioners are directed to be enlarged on bail in Patna High Court CR. MISC. No.86231 of 2024(4) dt.04-04-2025 3/3 connection with Kutumba P.S. Case no.120 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Aurangabad, Bihar.
