Heard Sri Qaisar Kamal Ansari, learned counsel for the applicants and Sri Vishwa Deepak Mishra, learned AGA for the State. 2. The present 528 BNSS application has been filed to quash the Non Bailable Warrant dated 04.08.2018, Charge Sheet dated 10.02.2017, arising out of Case No. 424 of 2020, (State vs. Wajiul and others), arising out of Case Crime No. 1255 of 2016, under Sections 325, 323, 504, 506 IPC, Police Station Madhuban, District Mau as well as cognizance/ summoning order dated 05.01.2018, pending in the Court of Additional Chie Judicial Magistrate, Mau as well as proceeding under Sections 82 and 83 Cr.P.C. 3. Vide order of this Hon'ble Court dated 16.09.2025, learned AGA seeks time and was directed to get instruction on the point that on what basis Section 325 I.P.C. has been applied against the accused persons. Learned AGA has received instructions that injured has sustained thumb fracture. The said fact has not been disclosed by the applicants in the present petition and they have filed this petition concealing the material fact, as such, no Versus Counsel for Applicant(s) : Mohd Khalid Ansari, Qaisar Kamal Ansari Counsel for Opposite Party(s) : G.A.
