JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of BNSS praying to grant bail in Crime No.142/2025 of Kikkeri Police Station registered for offences punishable under Section 115(2), 132, 3(5) of BNS. 2. Heard learned counsel for petitioner and learned HCGP for respondent/State. 3. Learned counsel for petitioner would contend that petitioner is a woman and she is in judicial custody since 11.09.2025. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The offences alleged against the petitioner are provided with a punishment for imprisonment for one year and two years for offences under Sections 115 and 132 of BNS. Per contra, the learned HCGP would contend that the petitioner has obstructed a public servant from discharging his duties. The charge sheet shows prima-facie case against the petitioner. With this, she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused the charge sheet and other materials placed on record. 6. The charge sheet indicates that the offences alleged against the petitioner and another accused are under Section 115(2) and 132 of BNS. Section 115(2) of BNS is provided with a punishment which may extend to 1 year. The offence under Section 132 is provided with a punishment of imprisonment which may extend to 2 years. The petitioner is in judicial custody since 11.09.2025. As the charge sheet is filed, she is not required for further interrogation. The petitioner is a woman aged about 50 years. The petitioner is not having any criminal antecedents. Considering the above aspects, the petitioner - 4 - HC-KAR NC: 2025:KHC:46398 CRL.P No. 13822 of 2025 has made out a case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed. The petitioner is granted bail in Crime No.142/2025 of Kikkeri Police Station subject to following conditions: (i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like-sum to the satisfaction of trial Court. (ii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly.
