Rai, learned counsel for the opposite party. Pursuant to the order of this Court dated 18.8.2025, Sri P.N. Rai, learned counsel for the opposite party has produced the instruction dated 18.8.2025, which is taken on record. On the basis of instruction, he submits that the order of the writ court has been complied with as passport of applicant has been issued, therefore, application has become infructuous. Learned counsel for the applicant disputed the aforesaid facts and submitted that though the passport has been issued under the category of ECR whereas he wanted to issue his passport under the category of Non-ECR. Therefore, under such facts of the case, no further order is required to be passed. Accordingly, file is consigned to record. However, liberty is given to applicant to challenge the decision so taken by the opposite party, if so desired.
