The petitioner has filed this petition seeking the following relief(s):- “10.1 That this Hon'ble Court may kindly be pleased to issue notices to the respondents returnable within a early date of hearing. 10.2 That this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to initiate land acquisition proceeding as per Act 2013 and to pay just and fair compensation within stipulated period in lieu of acquisition of land belongs to the present petitioner for construction of road. 10.3 Any other relief, which may be deemed, fit by REKHA SINGH Digitally signed by REKHA SINGH -2- this Hon'ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner.” 2. Mr. Pandey, the learned counsel appearing for the petitioner would submit that part of land bearing Survey No.1770 admeasuring 1.76 acres situated at Premnagar, Patwari Circle No.13, Tehsil Premnagar, District Surajpur(C.G.) has been utilized by Nagar Panchayat Premnagar for the construction of a road without land acquisition. He would pray that a direction may be issued to respondent No.4 either to pay compensation or to allot equitable land. 3. On the other hand, learned Advocates appearing for the respondents would oppose the submissions made by Mr. Pandey. 4. I have heard learned counsel appearing for the parties and perused the documents placed on the record. 5. Taking into consideration the limited prayer made by Mr. Pandey, this petition is disposed of reserving liberty in favour of the petitioner to make a representation before respondent No.4 within a period of 10 days and in turn, respondent No.4 is directed to decide the representation preferably within a period of 30 days from the date of receipt of a copy of this order. 6.
