Heard learned counsel for the petitioner, Shri Rajiv Gupta, learned Additional Chief Standing Counsel for the State-respondents and Shri Ishan Deo Giri, learned counsel for respondent no.2. 2. Learned Standing Counsel has placed on record the written instructions received from Competent Authority, Shahjahanpur and District Magistrate, Shahjahanpur, according to which, dispute relating to apportionment has been referred to the Land Acquisition and Rehabilitation Authority under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The same position is evident from a communication dated 07.03.2024 by Competent Authority annexed as Annexure-2 to the supplementary affidavit. 3. The prayer made is for a direction to the Authority to decide the reference expeditiously. 4. A perusal of the order-sheet reveals that, although, the opposite parties are reported to be absent on several dates but it is not clear whether the opposite parties have been served or not. 5. Learned counsel for the petitioner is also not in a position to clarify the same. Therefore, at this stage, we decline to issue any direction but leave it open to the petitioner to make appropriate application before the Authority for expeditious disposal of the proceedings. 6.
