Since the learned counsel for the appellant passed away, this Court directed issue of notice to the appellant on 01.03.2024. 3. The notice sent to the appellant was returned unserved with the endorsement ‘no such addressee in that office’. There is no other address of the appellant available on record. Hence, the service of notice on the appellant is deemed to be sufficient. 4. In view of the above, the Motor Accident Civil Miscellaneous Appeal is dismissed for non-prosecution. There shall be no order as to costs. Interim orders granted earlier, if any, shall stand vacated.
