1. The present petition has been filed by the petitioner for grant of anticipatory bail in case FIR No.47 dated 27.03.2025, registered under Sections 21(a) and 29 of NDPS Act, 1985 added later on vide Rapat No.18 dated 29.03.2025, at Police Station City Malout.
2. Learned State counsel submits that the offence under Section 238 of BNS was added during the course of investigation. On oral request of
learned counsel for the petitioner the aforementioned offence under Section 238 of BNS is ordered to be added in the headnote and prayer clause of the petition.
3. Vide order dated 01.08.2025, passed by this Court, the petitioner was granted interim bail and directed to join investigation.
4. Learned State counsel on instructions from the Investigating Officer, has submitted that the petitioner has joined investigation on 09.08.2025 and he is not required for custodial interrogation. NISHA 2025.09.03 10.54 I attest to the accuracy and integrity of this document

5. Keeping in view the nature of the allegations, pre-trial incarceration of the petitioner is also not required. As such, a case is made out for allowing the present petition. Accordingly, the present petition is allowed and the order dated 01.08.2025, granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (analogous to Section 438(2) of the Code of Criminal Procedure).
