JUSTICE LALITHA KANNEGANTI ORAL ORDER Aggrieved by the orders passed in MC.No.5184/2025 dated 17.10.2025 by the II Addl. Prl. Judge, Family Court, Bengaluru, the husband is before this court. 2. The present writ petition is filed questioning the order dated 17.10.2025 whereby the Family court in a petition that is filed under Section 13-B of the Hindu Marriage Act had dispensed with the statutory cooling period of six months, however directed the appearance of the parties and their parents for conciliation along with their photo IDs and directed - 3 - HC-KAR NC: 2025:KHC:52710 WP No. 34607 of 2025 the matter to be called on 28.10.2025. Again on 28.10.2025 the matter was adjourned to 15.11.2025 to comply with last date order. 3. Learned counsel appearing for the petitioner submits that in an application filed under Section 13-B of the Hindu Marriage Act, the order of the family court directing the parents to be present is not warranted and in fact the parents are staying in far away places and it is difficult for the parents to come. Earlier when this was brought to the notice of the family court, still the learned judge is insisting for the parents to come before the court. 4. This court had already directed the learned Judge not to insist for the presence of the parents, but in spite of the same this order is passed. 5. Accordingly, this court is passing the following: ORDER i. The order passed in MC.No.5184/2025 dated 17.10.2025 by the II Addl. Prl. Judge, Family Court, - 4 - HC-KAR NC: 2025:KHC:52710 WP No. 34607 of 2025 Bengaluru insisting for the presence of the parents is set aside. ii. The writ petition is Allowed. iii. The parties shall appear before the Karnataka Mediation Centre, Bangalore on 19.12.2025. iv. All pending I.As., in the petition shall stand closed.
