Neutral Citation No. - 2025:AHC:140834 Court No. - 77 Case :- WRIT - C No. - 27580 of 2025 Petitioner :- Smt. Khusbu Hussain And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Shantanu Pandey,Shashi Kant Pandey Counsel for Respondent :- C.S.C. Hon'ble Saurabh Srivastava,J.
1. Heard Sri Shashi Kant Pandey, learned counsel for petitioners and learned Standing Counsel for the State- respondents.
2. By way of the present writ petition, a direction in the nature of mandamus directing the respondents not to interfere in peaceful marital life of petitioners, has been sought.
3. It is fairly apprised by learned counsel for petitioners that an FIR has already been instituted in the State of Assam, since petitioner no. 1 belongs to Assam, petitioner no. 1 is intended to record her statement under Section 161 Cr.P.C. before the concerned investigating officer and as such protection is required.
4. Learned Standing Counsel has vehemently opposed the prayer as made in through the instant petition and rebutted the stand as taken up by learned counsel for the petitioners on the ground that the instant roster does not permit to extend police protection in favour of any witness or any party who are in litigation or any inquiry pending against them.
5. Grounds as taken up by learned Standing Counsel seems to be justified but at the same time, petitioners are at liberty to avail all the other alternative remedies for seeking seeking police protection, specifically in favour of petitioner no. 1 before appropriate forum.
6. The writ petition stands disposed of accordingly. Order Date :- 18.8.2025 #Vik/- Digitally signed by :- VIKRAM GUPTA High Court of Judicature at Allahabad
