As per the office report dated 27.02.2023, notice has been served to respondent no. 2, but no representation has been made in person or through his counsel to contest the matter. 3. The present Cr.M.P. has been filed with the following prayer:- “ It is, therefore respectfully prayed that the Hon’ble Court may be kind enough to allow the application and stay the effect and operation of impugned First Information Report (F.I.R.) No. 282/2022, registered by Police Station Mana Camp, District Raipur, C.G. Annexure A/1, in the interest of justice.” 4. That, the case of the prosecution is that the complainant filed written complaint in the police station Mana Camp, Raipur inter alia alleging that the complainant is engaged in the business of sale and purchase of Billet and Ingot which are product of Iron. For the purpose of business one firm of Delhi namely Prime Gold Sale J.V.C Ltd. contacted to their firm and made contract for purchase of Billet and assured that when the commodity will reach to them they would pay the consideration within fifteen days and complainant send the Billet commodity to them on 09.02.2016 by Bill no. R/B/175/15-16 for the consideration of Rs. 9,55,588/- & dated 12.02.2016 Bill no. 3 R/B/176/15-16 for the consideration of Rs. 10,44,563/- and thereafter fifteen days complainant asked for the consideration then accused were on one or another ground delayed for payment of amount and after some time no one pick the call of complainant and when they were personally approached them in Delhi then they were issued two cheques bearing no. 786682 and 786686 dated 14.07.2016 & 14.10.2016 for the amount of 10,00,000/- each and when the cheques were presented before the bank on 25.07.2016 and 08.12.2016 both cheques were dishonored with remark of insufficient funds. Thereafter again approached to accused for payment of amount but they were misbehaved with complainant and the accused refused for payment of money to complainant and threatened him and told that he would not pay any amount to him and thereby the director of Prime Gold have committed the offence of cheating with complainant and upon this written report the offence under section 420 of IPC has been registered against the applicants., the applicant being aggrieved with the registration of First Information Report (F.I.R) No. 282/2022, registered by Police Station Mana Camp, District- Raipur, C.G, Annexure-A/1, prefer the instant petition for quashment of the above F.I.R and consequent criminal proceedings. 5. Learned counsel for the petitioner would submit that dispute in parties is purely of civil nature, earlier also an FIR was lodged by the private respondent no. 2 against the petitioner in which the police submitted a report under Section 155 Cr.P.C and concealing the said fact the present FIR has been lodged. It is further pointed out that as per the 4 return filed by the State the matter has been amicably settled between the petitioner and respondent no. 2 as has been stated in para 8, a copy of the agreement has also been enclosed. 6. In view of the above submission made by the counsel and looking to the compromise deed, It is evident from the record that the compromise arrived at between the parties this CRMP is allowed subject to fulfillment of terms and condition of the compromise deed dated 22.12.2022 and accordingly FIR No. 282/2022 dated 08.11.2022 registered by Police Station Mana Camp District Raipur (C.G.) for the offence U/s 420 of IPC and all the consequential proceedings arising out the above said FIR against the petitioners is here by quashed.
