JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner/accused No.5 has preferred this petition under Section 483 of BNSS, 2023 to enlarge him on bail in Cr.No.230/2025 of Yelahanka Police Station, registered for the offence under Section 109(1), 118(1), 3(5) and 352 of BNS, 2023. 2. Heard both sides and perused the material on record. 3. A perusal of the complaint lodged by Munikrisna S/o Krishnappa reveal that he was working as a driver of the T.T. vehicle. On 26.6.2025 at about 2.30 p.m. when he had parked his T.T. vehicle near Venkatachala Canadian School for washing, the accused persons came in a car and two wheeler took objection for parking his vehicle, abused him and assaulted on his head with rod, - 3 - HC-KAR NC: 2025:KHC:29844 CRL.P No. 10757 of 2025 wooden stick and with hands. He was admitted at Government Hospital, Yelahanka, wherein he took treatment for the injuries sustained by him. 4. FIR is registered against accused Nos.1 to 3 by name Suri, Sanjay and Suhail. It is alleged that the said three accused along with their associates came in a car and two wheeler, picked up quarrel with the complainant and assaulted him with a metal rod, club and hands, on his head etc. 5. Name of the petitioner is not found in the FIR. In the complaint, it is specifically stated that accused Nos.1 to 3 have assaulted the complainant. There is no allegation whatsoever against the present petitioner. In the remand application, he is arraigned as Accused No.5. 6. Learned High Court Government Pleader has made available a copy of the wound certificate of the complainant/injured wherein it is mentioned that the injuries sustained are simple in nature. - 4 - HC-KAR NC: 2025:KHC:29844 CRL.P No. 10757 of 2025 7. Petitioner was arrested on 28.6.2025. He has no criminal antecedents. He has undertaken to furnish surety to ensure his regular presence before the trial Court. Hence, the following: ORDER i. Petition is allowed. ii. Petitioner/accused No.5 in Cr.No.230/2025 of Yelahanka Police Station pending on the file of the Court of VII ACMM, Nrupatunga Road, Bengaluru City, shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only), with one surety for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3.
