This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 33(1)(a) of IPC. 3. Learned counsel for the petitioner submits that logs were purchased in auction which was being transported in the vehicle of the petitioner, which would be apparent from Annexure-2, which is the auction receipt. 4. The learned APP opposes the prayer for anticipatory bail and submits that auction receipt is dated 07.01.2022, whereas the vehicle of the petitioner was found inside the forest loaded with sheesham logs on 12.07.2022. 5. After hearing the parties, I find that the vehicle of the petitioner was found loaded with illegal sheesham logs in the forest area. Further, Annexure- 2 i.e. auction receipt, which the petitioner relying upon is of no consequence as the same is dated 07.01.2022, whereas the vehicle of the petitioner was seized in July, 2022, thus, the material which was loaded in the vehicle of the petitioner, prima facie cannot be said to be purchased in auction, which was held on 21.12.2021, which is reflected in auction receipt dated 07.01.2022, I find that this is not a fit case for grant of anticipatory bail to the petitioner. 6. Accordingly, the prayer for anticipatory bail of the petitioner in connection with G.(F) Case No.1960 of 2022, pending in the Court of learned C.J.M., Hazaribagh, stands rejected. (ANANDA SEN, J.)
