ORAL ORDER
1. The wife of detenu - Chandan D (CTP 15253) is before this Court seeking for the following reliefs: a. Extend the general parole granted by this Hon’ble Court by 60 days to the convict, Sri. Chandan D S/o Late Devaraju (CTP No.15253) from 11.09.2023.
b. Pass such other order’s, direction’s considering the
facts and circumstances of the case, together with costs, in the interest of justice.
2. The detenu had been convicted for offences under Section 143, 147, 148, 341 r/w 149 of IPC and 149, 302 and 120B of IPC in SC No.87/2019 by IV Additional District and Sessions Judge, Mandya and sentenced on 02.04.2025, highest of the sentence being for life imprisonment. The detenu was granted

parole on 10.09.2025 on account of his marriage for a period of 30 days. The detenu has thereafter surrendered himself before the jail authorities and the present petition has been filed for extension of parole.
3. Though the learned AGA opposes the grant of extension of parole on the ground that the detenu has surrendered himself before the jail authorities and there is required to be a gap of at least six months before a fresh application were to be considered.

I am of the considered opinion that the detenu having been released on parole, having complied with the conditions which had been imposed and surrendered to the jail authorities, the earlier parole having been granted on account of his marriage, it would be in the interest of justice that the parole of the detenu is extended by a further period of 60

days. In that view of the matter, I pass the following:
ORDER i) The Writ Petition is allowed. ii) Respondent No.2 – Chief Superintendent, Central Prison, Bangalore, is directed to release Chandan D, CTP 15253, on parole for a period of 60 days commencing from 17.11.2025 or from the date of release, whichever is earlier, subject to the following conditions: a) The convict shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take him to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole.

b) Respondent No.1 shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii) The Registry is directed to communicate the
order to the prison authority for its immediate execution.
