1. Heard counsel for the applicant, Sri Abhishek Singh, counsel for the informant and Sri Shashank Shekhar Pandey, learned AGA for the State- opposite party. Perused the material available on record. 2. The present bail application has been filed with the prayer to enlarge the applicant on bail in Case Crime No. 282 of 2025, under Sections 281, 105, 324(4) B.N.S., Police Station- Maharajpur, District- Kanpur Nagar, during the pendency of the trial. 3. Counsel for the applicant submits that the applicant has been falsely implicated in the present case. The son and the wife of the informant died in an accident. The applicant was the driver of the alleged truck. The applicant had no intent to cause their death. At this stage, there is no credible evidence to link the applicant with the offence. The applicant has no criminal antecedents. The applicant is in jail since 09.7.2025 and in case, he is enlarged on bail, he will not misuse the said liberty. 4. Learned AGA and counsel for the informant have opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record. 5. Having heard counsel for the parties and having perused the record this Court prima facie finds that at this stage, there is no substantive evidence to link the applicant with the offence. Further, the applicant has no criminal antecedents and has remained confined for about three months and there is no hope of early conclusion of trial, more so when no reasonable apprehension has been brought to the fore by the State that the applicant, if Versus Counsel for Applicant(s) : Praveen Kumar Tripathi, Shri Krishna Tripathi Counsel for Opposite Party(s) : Abhishek Singh, G.A., Shailendra Singh Rishabh Raj Singh .....Applicant(s) State of U.P. .....Opposite Party(s)
