ITEM NO. 112 Regular List. IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR ……. WP(C) 1920/2025 CM(5087/2025). HINA BASHIR. …Petitioner(s) Through: Mr. Sajad Ashraf, Advocate. VERSUS UNION TERRITORY OF J AND K (REVENUE) AND ORS. …Respondent(s) Through: Mr. Illyas Nazir Laway, GA. CORAM: HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 03.09.2025 The matter is taken out of turn at the request of the learned counsel appearing for the petitioner. Mr. Sajad Ashraf, learned counsel for the petitioner, has drawn attention of this Court to the relief prayed for, which is an innocuous prayer seeking a direction to the respondents for immediate and conclusive demarcation of the petitioner’s land measuring 03 kanals at Midoora, Tehsil Awantipora under the specified Survey No. 1464/1362/1195, Khewat No. 177 Khata No. 744. He submits that the petitioner would feel satisfied if the petition is disposed of by directing the respondents to carry out such demarcation within a reasonable time. Mr. Laway, learned counsel for the respondents, has no objection if the prayer of the petitioner to that extent is allowed provided there is no legal impediment in doing so. In view of the consensus between the parties, the petition is taken up for disposal at the threshold and is accordingly disposed of by directing Respondent No. 3, Deputy Commissioner, Pulwama, to constitute a team of Revenue Officials headed by the Tehsildar, Awantipora, within a period of two weeks from the date a copy of this order along with the writ petition is served upon him. The said team shall carry out the demarcation of the petitioner’s land within a further period of four weeks, thereafter, subject to there being no legal impediment that too, after notifying the date of such demarcation well in advance to the petitioner and all the other stakeholders who have remote link with the said land in question for such demarcation. The petitioner is also at liberty to provide the requisite documents if required for carrying out the said demarcation before the concerned Deputy Commissioner. The entire exercise shall be completed within a period of six weeks, from the date copy of this order is served to the respondents. Disposed of accordingly.
