Despite service of notice on opposite party no.2, no one has turned up to oppose bail cancellation application. Heard Sri Sukhendra Singh, learned counsel for applicant and learned AGA for State. The instant bail cancellation application has been filed on behalf of the applicant, Neetu Singh, with a prayer to arrest and cancel the bail granted to him in Complaint Case No. 1569/2015, under Sections 377, 498-A, 323 of IPC, and section 3/4 of D.P. Act, Police Station- Gandhi Park, District- Aligarh, during pendency of trial. Learned counsel for the applicant has submitted that the bail granted to the applicant vide order dated 08.11.2017 by the Additional Chief Judicial Magistrate, Aligarh, may be cancelled on the ground that none of the witnesses are appearing before the trial court after the grant of bail. The bail granted to the applicant may be cancelled. After hearing the learned counsel for the applicant and going through the order sheet of the trial court, it appears that as yet on most of the dates adjournments have been sought by the applicant and other co-accused. Learned counsel for the applicant has further submitted that the opposite party no.2 is misusing the liberty of bail. In view of the above facts and circumstances, the bail granted to the applicant is hereby cancelled. Bail cancellation application is allowed.
