This Appeal under Order 43 Rule 1 (r) C.P.C. has been filed against the order dated 07.05.2025 passed by learned Civil Judge (Senior Division), Dehradun in Original Suit No.162 of 2025, whereby the learned trial Court has restrained the appellants/defendants from interfering in the peaceful possession of the respondents/plaintiffs and directed the parties to the suit to maintain status quo over the suit property. 3. A Co-ordinate Bench of this Court vide order dated 03.07.2025 stayed the effect & operation of the order dated 07.05.2025. 4. Heard learned counsel for the parties and perused the record. 5. Learned counsel for the parties submit that objection to the application under Order 39 Rule 1 & 2 C.P.C. have already been filed and have mutually agreed that the present Appeal from Order may be disposed of with a direction to learned trial Court to decide the application under Order 39 Rule 1 & 2 C.P.C., on its own merit, within the stipulated period. 2025:UHC:7449 6. In view of consensus recorded by learned counsel for the parties, the Appeal from Order is disposed of with a direction to learned trial Court to decide the application under Order 39 Rule 1 & 2 C.P.C., as expeditiously as possible, preferably within a period of two weeks’ from the date of production of certified copy of this order. 7. Till disposal of application under Order 39 Rule 1 & 2 C.P.C., parties shall maintain status quo over the suit property.
