Jyotsna Rewal Dua, Judge Even though the reply has not been filed by the respondents, however, with the consent of learned counsel for the parties, matter is heard at this stage. 2. Yeshwant Singh Khimta & Ors. vs. State of H.P. & Ors.1 was instituted, wherein the present petitioner was also one of the petitioners, seeking benefit of Ranjit Singh & Ors. vs. State of H.P. & Ors.2. Yeshwant Singh Khimta1 was disposed of with directions to the respondents to consider and decide the representations of the petitioners in light of Ranjit Singh2. 1 CWP No.5024 of 2024 decided on 31.05.2024. 2 CWP No.2500 of 2021 decided along with connected matters on 07.07.2023. -2- Respondent No.3–Deputy Director of Elementary Education, Shimla, considered the present petitioner’s representation and vide order dated 18.10.2024 (Annexure P- 6), rejected the same on the ground that the petitioner’s case did not fall within the purview of Ranjit Singh², as she had been promoted as Central Head Teacher before 01.10.2012. 3. Parties are ad idem that the aforesaid issued has been adjudicated in Surya Prabha & Ors. vs. State of H.P. & Ors.3 and further that the case of the petitioner is required to be considered afresh in light of Surya Prabha3. 4. In view of above submission, impugned order dated 18.10.2024 is quashed and set aside and respondent No.2/Competent Authority is directed to consider and decide the case of the petitioner afresh for the relief claimed by him within six weeks in accordance with law keeping in view the decision rendered in Surya Prabha3. The order so passed be also communicated to the petitioner. The writ petition stands disposed of in the above terms. All pending miscellaneous application(s), if any, to also stand disposed of.
