Heard the parties.
Apprehending their arrest in connection with Pakur (M) P.S. Case No.223 of 2024 instituted under Section 126(2)/115(2)/117(2)/303(2)/ 352/3(5)/103(1) of the B.N.S., 2023, the petitioner has moved this Court for grant of privileges of anticipatory bail.
Learned counsel appearing for the petitioners submits that the allegation against the petitioners is that the petitioners in furtherance of common intention with the co-accused persons committed the murder of Aaju Sheikh and committed theft of Rs.5,030/- from the pocket of the informant. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-12 of the instant bail application, learned counsel for the petitioners submits that the petitioners have no criminal antecedent. It is next submitted that the allegations are general and omnibus in nature. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
Learned Addl.P.P. appearing for the State opposes the prayer for grant of anticipatory bail to the petitioner and submits that keeping in view the serious nature of allegation against the petitioners of committing murder
Aaju Sheikh, custodial interrogation of the petitioners is required during the investigation of the case to find out the details of the case. Hence, it is submitted that the petitioners ought not to be given the privileges of anticipatory bail.
Considering the serious nature of allegation against the petitioners of committing murder of Aaju Sheikh as well as the requirement of their custodial interrogation to find out the details of the case, this Court is not inclined to give the privileges of anticipatory bail to the abovenamed petitioners. Accordingly, the prayer for grant of privileges of anticipatory bail to the abovenamed petitioners is rejected.
