Grievance of the petitioner is that in terms of the contract awarded for installation of Hand Pumps, the dues of the petitioner are not released despite completion of work for sufficiently long. On the previous occasion, time was granted to learned Standing Counsel to obtain instructions. Instructions are furnished today by the learned Standing Counsel, according to which a three member fact finding committee was constituted, which has found specified number of the Hand Pumps to have been validly installed. Be that as it may, we are not inclined to enter into factual issues as to how many Hand Pumps have been validly installed or not. In the facts of the case, we dispose of this writ petition with a direction upon the concerned District Magistrate to ensure that proper enquiry in the matter is got conducted and concluded such that amount found due and payable to petitioner is released, within a period of two months from the date of presentation of a certified copy of this order.
