By way of this writ petition, the petitioners are assailing Annexure P-1, which is an order passed by the District Panchayat Officer, revoking the order of suspension of the private respondent, who is stated to be the Pradhan of the Gram Panchayat Kathwar, Block Development Tilordhar, District Sirmour, H.P.

On a query put to learned Counsel for the petitioners as to who are the petitioners, learned Counsel for the petitioners submitted that they are the voters of the Panchayat concerned. He further submitted that they have invoked the jurisdiction of this Court, as according to them, many illegalities and irregularities have been committed by the private respondent.

Having carefully gone through the pleadings as well as documents appended therewith, this Court is of the considered view that this writ petition, as filed, is not maintainable as the petitioners are not espousing any personal cause. In case, they intend to pursue a public cause, then they have to file a public interest litigation on the prescribed proforma and in the manner, a public interest litigation has to be filed.

At this stage, learned Counsel for the petitioner, under instructions, prays for and is permitted to withdraw present writ petition, with liberty to file a public interest litigation. Pending miscellaneous applications, if any, also stand disposed of accordingly.
