The present petition has been filed challenging the First Information Report dated 22.7.2025 registered as Case Crime No.150 of 2025 under Sections 318(4), 338, 336(3), 340(2), 61(2), 316(2) B.N.S. Police Station Baah District Agra. It has been argued by the counsel for the petitioner that the petitioner was employed as a Security Guard on contract basis by the NSS Solutions Pvt.Ltd., and it was not possible for the petitioner to indulge in the offence referred in the F.I.R. It was argued that even from the recitals in the First Information Report, no offence under Section 338 B.N.S is made out. It was argued that the petitioner was involved in the First Information Report only to save the person responsible for the fraud referred in the First Information Report. It was argued that for the aforesaid reason, the First Information Report so far as it concerns the petitioner is liable to quashed. The A.G.A. has opposed the petition and states that from the recitals in the First Information Report, it is evident that the offence is committed by the petitioner. I have considered the submissions of the counsel for the parties. The writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 22.7.2025 registered as Case Crime No.150 of 2025 under Sections 318(4), 338, 336(3), 340(2), 61(2), 316(2) B.N.S. Police Station Baah District Agra till submission of the Police Report under Section 193 of Bhartiya Nagrika Suraksha Sanhita, 2023. With the aforesaid directions, the writ petition is disposed of.
