Neutral Citation No. - 2025:AHC:139052-DB Court No. - 45 Case :- CRIMINAL MISC. WRIT PETITION No. - 17848 of 2025 Petitioner :- Ramsevak Nishad Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Kumar Parikshit,Ritesh Kumar Counsel for Respondent :- G.A. Hon'ble Salil Kumar Rai,J. Hon'ble Zafeer Ahmad,J. Heard the counsel for the petitioner and the AGA for the State respondents. The present petition has been filed challenging the First Information Report dated 19.7.2025 registered as Case Crime No.0098 of 2025 under Section 108 of B.N.S., 2023 Police Station Shankargarh, District Yamunagar. (Commissionerate Prayagraj). It has been argued by the counsel for the petitioner that there is no evidence implicating the petitioner under Section 108 B.N.S.S. and the recitals made in the F.I.R. are false and made only because the family members of the deceased did not relish the relationship between the petitioner and the deceased. It has been argued that for the aforesaid reason, the F.I.R. is liable to be quashed. The AGA has opposed the petition. It would serve no useful purpose to keep the writ petition pending. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 19.7.2025 registered as Case Crime No.0098 of 2025 under Section 108 of B.N.S., 2023 Police Station Shankargarh, District Yamunagar. (Commissionerate Prayagraj) till submission of the Police Report under Section 193 of Bhartiya Nagrika Suraksha Sanhita, 2023. With the aforesaid directions, the writ petition is disposed of.
