Neutral Citation No. - 2025:AHC:6030 Court No. - 76 Case :- APPLICATION U/S 482 No. - 27742 of 2024 Applicant :- Ram Tirth Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Manish Kumar Singh Counsel for Opposite Party :- G.A. Hon'ble Vinod Diwakar,J. 1. The applicant is aggrieved by the impugned order dated 26.10.2023, passed by the learned Special Judge, Special Court (POCSO Act)/Additional Sessions Judge, Meerut, in Case No.864 of 2020, titled State v. Ram Tirth, arising out of Case Crime No.545 of 2020, registered under Sections 363 and 377 of the IPC and Sections 5/6 of the POCSO Act, at Police Station Partapur, District Meerut. By the said order, the learned trial court rejected the applicant's application filed under Section 311 of the Cr.P.C. 2. Upon perusal of the record, it transpires that the chief examination of the victim was recorded on 28.9.2022. However, the order sheet does not reflect any mention or reference to subsequent orders passed during the proceedings, leaving an evident gap in the continuity of the order passed in the present case and besides order, the documents annexed with the petition are insufficient. 3. In light of the above circumstances, the instant application is dismissed for want of sufficient documents to take cognizance of the prayer made in the petition. However, the applicant is granted liberty to file a fresh application, duly supported by complete and relevant documents. Order Date :- 10.1.2025 Anil K. Sharma Justice Vinod Diwakar Digitally signed by :- ANIL KUMAR SHARMA High Court of Judicature at Allahabad
