Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 of Bharatiya Nagarik Suraksha Saniha, 2023, seeking transfer of Criminal Case No.841 of 2015, titled Annu Giri Vs. Jitendra Giri & others, under Sections 12, 18, 19, 20, 22, 23 of the Protection of Women From Domestic Violence Act, 2005, Police Station- Barra, District Kanpur Nagar pending in the court of Civil Judge (Junior Division) Court No.7 Kanpur Nagar to the competent court of jurisdiction at district- Prayagraj. While referring to the prescription slip Annexure 2, it is contended by learned counsel for the applicant-husband that it is difficult for him to attend the trial proceedings at Kanpur arising from a complaint under Section 12 Domestic Violence Act, 2005. He prays that the trial be transferred to Prayagraj where the applicant resides. A perusal of the medical prescription shows that the applicant has been advised medication for neck sprain. Further, it is also not disputed by learned counsel that the applicant being in a government job is continuing with his job. The sole ground of ailment which is not permanent is not sufficient for transfer of the case, particularly when the towns are conveniently connected. This application is dismissed.
