Petitioner and his learned counsel are present. 2. Respondent and his learned counsel are present. 3. A joint memo is filed and it is signed by petitioner, respondent and their respective learned counsel. As per the joint memo the matter is settled for Rs.3,00,000/- including Rs.1,59,000/- deposited by the petitioner before the trial Court. Today, petitioner has paid a sum of Rs.50,000/- to the respondent by cash. Respondent reports receipt of cash of Rs.50,000/-. Petitioner has no objection for the respondent withdrawing Rs.1,59,000/- deposited before the trial Court. Petitioner has undertaken to pay the balance amount of Rs.91,000/- - 3 - HC-KAR NC: 2025:KHC:26450 CRL.RP No. 434 of 2021 within 1 month from this day. If petitioner fails to pay the balance amount of Rs.91,000/- within 1 month from this day, the judgment passed by the trial Court would revive. 4. In view of the above settlement, offence under Section 138 of Negotiable Instruments Act is compounded. In view of compounding of offence revision petition is disposed of as offence compounded. Respondent is permitted to withdraw Rs.1,59,000/- deposited by the petitioner before the trial Court. If the petitioner fails to pay the balance amount of Rs.91,000/- within 1 month from this day, the judgment passed by the trial Court will revive. 5. Respondent is directed to furnish his bank account details to the trial Court in order to enable the trial Court to transfer the amount in deposit to his Bank account directly.
