At the very outset, Shri Gaurav Mahajan, learned counsel for the respondent raises a preliminary objection with regard to maintainability of the writ petition on the ground that against the impugned order, the petitioner has equally, efficacious alternative remedy of filing an appeal before the Division Bench of this Court. Confronted with the said fact, learned counsel for the petitioner wants to withdraw the present writ petition at this stage with liberty to avail of remedy as available to the petitioner under the law. In view of the above the writ petition is dismissed as withdrawn with the liberty as prayed. Certified copy of the impugned orders, if any, shall be returned to the petitioner after retaining its photostat copy.
