The case of the complainant/petitioner is that he had given a sum of Rs.65,00,000/- to the respondent/accused for the purpose of construction. Subsequently, due to difference of opinion, the petitioner/complainant demanded refund of the said amount. Pursuant to which, the respondent/accused issued a cheque for the said sum of Rs.65, lakhs. When the same was presented for collection, it was returned with an endorsement “Account closed”. 3. I have heard the learned counsel appearing for the petitioner and perused the entire materials available on record. 4.
