Mr. S.S. Baghel, Govt. Advocate, for the State/ Respondent. Mr. Jitendra Gupta, learned counsel for the Objector. The present appeal has been preferred by the three appellants against the impugned judgment passed by learned trial Court and the appellant No. 2 Nahus who was stated to be released on parole on 21.05.2022 under the order of jail authorities, did not surrender after 14 days and he is still absconding. An explanation was called from the Director General, Prison regarding the steps taken by him for arresting the said appellant/ accused and he has filed his affidavit and stated that till date the said accused has not been arrested in spite of the best efforts made by the police authorities and the family members and other relatives could not tell the whereabouts of the accused and an FIR has also registered 2 / 2 sagrika against the said accused on 11.06.2022. As the other 11 accused/ appellants are also filed the appeal against their conviction and sentence by the trial Court and all those appeals are also connected with this appeal and all the accused persons in jail since April, 2016. Hence, the present appeal has been listed before this Court, it is not possible to adjourn these appeals for further period and we proceed to hear the appeals finally and judgment dictated separately. Mr. Virendra Verma, who is appearing in the present appeal for the appellant No. 1 and 3 who are the father and brother of the accused Nahus (appellant No. 2) and it is stated by him that initially the present appeal was entrusted through legal aid but at present he has only the power of appellant No. 1 & 3 as the appellant No. 1 and 3 are the father and brother of the appellant No. 2 (Nahus) who is absconding, we appoint Shri Virendra Verma to argue this appeal on behalf of the appellant No. 2 also and he is also appointed as amicus curie in the present case. As the said accused/ appellant No. 2 (Nahus) is still absconding, the Director General of Police is directed to execute permanent warrant issued against him for his arrest and when he is arrested, he shall be retained in jail as the present appeal filed by him along with co-appellant have been dismissed today on merits. Let the copy of this order be sent to the Director General of Police for necessary information. The matter heard finally and judgment dictated separately.
