(2) An eviction order was passed against the petitioners in proceedings under the provisions of Public Premises (Eviction of Unauthorized Occupants) Act, 1971. Petitioners filed appeals under Section 9 of the said Act, which are pending before 2nd Additional District Judge, Nainital and are numbered as Eviction Appeal No. 1 of 2024 and 2 of 2024. Since no hearing is taking place in those appeals on account of the Court of 2nd Additional District Judge being vacant, therefore, petitioners have approached this Court by filing this writ petition. (3) Learned Counsel for the petitioners submits that district administration is going to remove that portion of the house of petitioners which is allegedly constructed upon public land. He submits that in the event the part of the house is demolished, petitioners shall suffer irreparable loss. (4) Having regard to the facts of the case, writ petition is disposed of with 2025:UHC:6012 a request to In-charge District Judge, Nainital to assign the aforesaid appeals to any other competent court in Nainital or Haldwani, if the Court of 2nd Additional District Judge, Nainital is vacant, to ensure that appeals are decided without any further delay.
