BEFORE HONOURABLE MR. JUSTICE BUDI HABUNG ORDER Date : 21-04-2025 Heard Mr. U. Dutta, learned counsel for the applicant. I have also heard Mr. S. K. Goswami, learned counsel appearing for the opposite party no. 1/ Insurance company.
Page No.# 3/3 By an order dated 11.05.2022, passed in I.A.(Civil)/1310/2022, this Court while staying the operation of the impugned order has directed the opposite party/Insurance company to deposit 50% of the awarded amount in MAC case no. 06/2018 before the Registry. In compliance of the said direction the opposite party/Insurance company has deposited 50% of the awarded amount before the Registry. By filing this application, the claimant/respondent prays for release of the 50% of the awarded amount deposited by the appellant/opposite party. Mr. S. K. Goswami, learned counsel for the opposite party/Insurance company raised objection to the said prayer. Upon hearing the parties, the prayer of the applicant is allowed. Accordingly, the Registry is directed to release 50% of the awarded amount deposited by the opposite party/Insurance company to the applicant on execution of a bond of the like amount and on proper identification and verification by their learned counsel. With the above this IA stands allowed and disposed of. JUDGE Comparing Assistant
