This Civil Revision has been filed assailing the order dated 07.09.2022 passed in Civil Suit No.H-01A/2021 by the Additional District Judge, Fast Track Court, Mahasamund (C.G.), whereby the application preferred by the applicant/defendant under Order 7 Rule 11 of the CPC was dismissed. 2. At the outset, learned counsel for the applicant submits that the trial Court has observed that the question of limitation is the mixed question of law and fact, therefore, at this juncture, he seeks permission of the Court to withdraw this Revision. However, he prays for a direction to the concerned trial Court to frame proper issue on the question of limitation. 3. Learned counsel for the other side would not oppose the said prayer. 4. In view of the above, the Revision is dismissed as withdrawn. The trial Court is directed to frame proper issue on the question of limitation, which shall be decided in accordance with law. 5.
